ㅤㅤㅤSection 8 of the Maharashtra (Urban Areas) Protection and Preservation of Trees Act 1975, under which the tree-felling permission in question has been issued, restricts on felling of trees. And its Subsection (3) (a) expressly provides some criteria where tree-felling permission is meant to be given, such as, the tree is dead, or diseased or windfallen, or it constitutes a danger to life or property, or obstructs traffic. Additionally, the same clause expressly provides that such permission can be objected to.
ㅤㅤㅤThis objection is under Section 8 (3) (a) of the Maharashtra (Urban Areas) Protection and Preservation of Trees Act 1975 : Provided also that, no such permission shall be refused if, in the opinion of the Tree Authority or the Officer, as the case may be, the tree is dead, or diseased or windfallen, or it constitutes a danger to life or property, or obstructs traffic; and if any objection is received against such permission, the matter shall be placed before the Tree Authority or the Officer, as the case may be, for reconsideration, and a decision shall be taken within two weeks after giving a hearing to the person who has raised the objection.
ㅤㅤㅤThe trees in the GK BHS are not proposed to be felled because the trees are dead, or diseased or windfallen, or they constitute a danger to life or property, or obstruct traffic. Rather, they are proposed to be felled for the construction of an STP (Sewage Treatment Plant). Yet the felling permission has been issued under such an act, the object of which is to protect and preserve the trees and not to fell the trees. Section 8 says about the restrictions on felling of trees, so, by default the tree-felling permissions are supposed to be refused. That's why the aforementioned provision says for some specific criteria where the permissions shall not be refused. In case of the GK BHS trees, since they are not falling under those criteria, as per the objective of the act, permission for felling of these trees is supposed to be refused. So, we need to object to this permission in light of the aforementioned clause.
ㅤㅤㅤAs it is written in the clause "if any objection is received against such permission", there is no specific deadline to object. Yet let's object within 30 June 2026
